Terms & Conditions of Use: Meir® BIM Content (South Africa and Southern Africa)

These Terms & Conditions (“Terms”) govern the use of Building Information Modelling (“BIM”) content developed by R Skep (Pty) Ltd and distributed under license by Meir Wholesale (Pty) Ltd, trading as SIBO Trading (“SIBO Trading”), to professionals and institutions in South Africa and Southern Africa.

1. Purpose and Intended Use

This BIM content supports the digital planning, specification, and visualisation of Meir® products, intended for:

• Architects, engineers, interior designers, and specifiers
• Educational institutions for academic use

Usage is geographically restricted to South Africa and Southern Africa.

2. Intellectual Property Ownership

All BIM content is the exclusive intellectual property of R Skep (Pty) Ltd. No ownership is transferred to users or SIBO Trading. Only R Skep is authorised to modify or update the content.

3. License Terms

R Skep (Pty) Ltd grants Meir Wholesale (Pty) Ltd t/a SIBO Trading a non-exclusive, non-transferable, perpetual license to distribute the BIM content via a platform hosted by R Skep.

End users are granted a license to use the BIM content for:

• Design documentation and specification within professional projects
• Visualisation, tender submissions, and construction documentation for commercial or private development
• Educational and research purposes in academic institutions

The content may be used for commercial applications, including building plans, procurement packs, and contractor deliverables. However, it may not be resold, sublicensed, modified, or redistributed outside of its intended project use.

4. Usage Restrictions

• No editing, decompiling, or repackaging
• No resale or sublicensing
• No use outside Southern Africa
• No removal of embedded notices
• No misuse of brand affiliation

5. Product Pricing Metadata

All pricing included in the BIM metadata refers to Meir® product pricing (MSRP) at the time of file publication and is included for design and specification purposes only.

A price expiry date is listed in the metadata of each BIM object.

Agreed Project Rate BIM files may be requested for qualifying projects. (These files remain subject to all Terms & Conditions outlined herein, including license scope, usage restrictions, and technical disclaimers.)

SIBO Trading and R Skep are not liable for outdated or inaccurate pricing. Always confirm pricing with an authorized retailer.

6. Technical Disclaimer

R Skep (Pty) Ltd strives to ensure accuracy of all BIM data. However, discrepancies may occur. Users must verify all specifications, tolerances, and installation requirements using:

• Meir® Technical Data Sheets (TDS)
• Local technical advisors

7. Hosting, Maintenance, and Updates

R Skep hosts and maintains all content. Users are responsible for ensuring they work with the most current file version.

Version Control Reminder: Neither R Skep nor SIBO Trading is liable for outdated or superseded content in use.

8. POPIA Consent and Data Capture

The following data is collected prior to download:

• Full Name
• Firm
• Project Name
• Project Stage
• City
• Province
• Email Address
• Contact Number

By submitting this data, you consent to:

• Processing by R Skep and SIBO Trading
• Contact from approved Meir® retailers in your region

Data is stored securely and not shared with unrelated third parties.

9. Jurisdiction

These Terms are governed by South African law. All disputes will be resolved in South African courts.

10. Violation and Enforcement

Violation of these Terms may result in legal action, loss of access, and financial claims.

11. Amendments

Terms may change periodically. The latest version is hosted by R Skep and will be accessible via the Meir® South Africa website modal (www.meirsa.co.za).

12. Acceptance of Terms

By downloading or using Meir® BIM content, you confirm that you:

• Accept and understand these Terms
• Acknowledge R Skep’s ownership and rights
• Comply with POPIA, pricing terms, and usage rules
• Will not misuse, alter, or resell the content
